Terms & Conditions

Welcome to Tierloom. These Terms and Conditions ("Terms") govern your use of the Tierloom platform, including our website and all related services (collectively, the "Platform"), operated by Tierloom Technologies Private Limited("Tierloom", "we", "us", or "our").

By creating an account, accessing, or using the Platform in any capacity, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Platform.

These Terms apply to all users: Creators, Brands, Agencies, and any other registered users. We may update these Terms from time to time. When we make significant changes, we will notify you via email or a platform notification. Continued use after updates constitutes acceptance of the revised Terms.

Tierloom is an intermediary platform. Our role is to facilitate connections, manage the transaction process, and provide tools that make creator-brand collaborations more trustworthy and efficient. Specifically:

• We provide a verified identity network where creators showcase their professional history
• We provide a campaign marketplace where brands can discover, evaluate, and contract with creators
• We facilitate secure payment processing, including escrow-based deal transactions
• We provide analytics, messaging, and collaboration tools to support the deal lifecycle

To use Tierloom, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Not be barred from using the Platform under applicable law
• Provide accurate, complete, and up-to-date information during registration

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect any unauthorised access.

One person may operate one Creator profile and one or more Brand/Agency workspaces. Creating multiple accounts to circumvent platform policies is strictly prohibited.

A. Profile and Verified Data

• All information you submit — including your bio, work history, education, and portfolio — must be accurate and truthful. Misrepresentation may result in account suspension.
• Your career tier (Nano, Micro, Mid, Macro, Mega) is calculated automatically by the platform based on verified campaign history, delivery record, and client ratings. Tiers are system-assigned and cannot be self-requested or purchased.
• Completed campaign records and received reviews become a permanent part of your professional history on Tierloom, much like a verified resume. These cannot be deleted at will, as they are the trust foundation of the platform.

B. Campaign Applications and Deliverables

• When you apply to a campaign or accept a direct offer, you are entering into a commercial agreement with that brand for the specific deliverables outlined.
• You are solely responsible for creating content that complies with applicable advertising laws, ASCI guidelines, and any applicable platform rules.
• All deliverables must be submitted through the Tierloom platform. Submitting work outside the platform may compromise your payment protections.
• You are required to respond to brand messages and review requests in a timely manner.

C. Prohibited Conduct for Creators

• Submitting content that contains false, misleading, or illegal claims
• Using artificial methods to inflate engagement metrics (bots, click farms, purchased followers)
• Offering deliverables you do not have the capability, resources, or rights to produce
• Sharing campaign briefs, brand materials, or confidential terms outside the platform without brand consent

A. Campaign Creation and Management

• Brands are responsible for ensuring all campaign briefs, requirements, and product information are accurate, legal, and compliant with applicable advertising regulations.
• Campaigns that contain misleading claims, hate speech, or discriminatory content will be rejected. Campaign creation fees are non-refundable upon rejection for policy violations.
• Brands may maintain internal review notes on creator applicants. These notes are private to the brand workspace and are not shared with creators.

B. Discovering and Working with Creators

• Tierloom does not guarantee that any creator will accept a collaboration or produce results that meet specific business objectives.
• Brands acknowledge that Premium creator subscribers on Tierloom may be able to see that their profiles were viewed or that they reviewed a creator's media kit. This commercial intent transparency is a core platform feature.

C. Prohibited Conduct for Brands

• Attempting to contact creators directly to bypass platform fees or payment protections
• Creating campaigns with the intent to obtain creative work without fair compensation
• Misrepresenting your brand identity, budget, or campaign intent
• Using creator-submitted content beyond the scope of the agreed usage rights

A. The Deal Process

• A brand creates a campaign brief or sends a direct offer to a creator.
• Both parties may negotiate terms through up to five rounds of counter-offers.
• Once both parties accept the terms, the brand authorises payment. Funds are immediately captured and held in a secure escrow hold by Tierloom.
• The creator performs the agreed work and submits deliverables through the platform.
• The brand reviews the submission and either approves it, requests a revision (up to five revision rounds), or raises a dispute.
• Upon approval, or upon automatic release, funds are disbursed to the creator after platform fees are deducted.

C. Platform Fees

• Brand service fee: 5% of the agreed deal amount (added to the brand's total cost)
• Creator service fee: 10% of the agreed deal amount (deducted from the creator's payout)
• Payment gateway fees charged by Razorpay or Stripe are strictly non-refundable under all circumstances
• All platform service fees on completed and settled transactions are non-refundable

D. Refunds and Cancellations

Both parties may agree to a mutual cancellation before deliverables are submitted. If accepted, funds are refunded to the brand minus any non-refundable gateway fees. Once a creator has submitted deliverables and the auto-release window has passed, funds are non-refundable except through the formal dispute process.

If a deal enters a disputed state, both parties agree to submit to the binding arbitration of Tierloom Administrators.

• Both parties waive the right to litigate disputed escrow funds in court
• Users must submit their evidence and reasoning to Tierloom within 7 days of the dispute being raised
• Tierloom Administrators will review all submitted evidence and issue a final binding decision
• The decision may result in full release to the creator, full refund to the brand, or a percentage split

A. Creator Content

Unless explicitly stated otherwise in a campaign brief or deal agreement:

• The creator grants the brand a non-exclusive, time-limited licence to use the deliverable for the purposes described in the campaign brief
• Usage rights beyond the agreed scope (e.g., paid advertisements, third-party licensing, TV/broadcast, etc.) must be negotiated and agreed in writing before work begins
• Full intellectual property buyouts must be explicitly agreed and are typically priced accordingly

Tierloom is not a party to these IP arrangements. Disputes about content usage beyond the platform must be resolved between the Creator and Brand directly under applicable copyright law.

B. Tierloom Platform IP

All software, design elements, logos, trademarks, and content created by Tierloom are the exclusive property of Tierloom Technologies Private Limited. You may not copy, reproduce, reverse-engineer, or create derivative works from any part of the Tierloom platform without our explicit written permission.

Tierloom operates on a freemium model. Free accounts provide access to core discovery and profile features. Premium subscriptions unlock advanced features including detailed analytics, expanded campaign access, media kit customisation, and priority discovery.

• Subscription fees are billed in advance for the selected billing period (monthly or annual)
• For Creators, subscriptions are at the individual account level. For Brands and Agencies, subscriptions are at the workspace level
• All subscription fees are non-refundable. If you cancel, you retain access until the end of your current billing period
• Tierloom reserves the right to modify subscription pricing with advance notice. Price changes apply at the start of your next billing cycle
• Applicable taxes are added to subscription fees where required by law

The following activities are prohibited on Tierloom and may result in account suspension or permanent disabling:

• Providing false, misleading, or fabricated information anywhere on the platform
• Artificially inflating social media metrics through bots, click farms, or other inauthentic means
• Attempting to solicit or complete transactions outside the platform to avoid fees
• Harassing, threatening, or abusing other users
• Uploading or sharing content that infringes on third-party intellectual property rights
• Attempting to reverse-engineer, scrape, or extract data from the platform without authorisation
• Creating multiple accounts to circumvent platform policies, suspensions, or feature limits
• Using the platform to engage in illegal activities of any kind
• Sharing another user's private information without their consent

Tierloom reserves the right to review, remove, or restrict content that violates these Terms or our community standards. Users may report content, profiles, reviews, or messages they believe violate platform policies.

Account Actions for Violations

We may take the following actions depending on severity:

• Content removal or editing
• Temporary suspension of specific features (e.g., campaign creation, messaging)
• Temporary account suspension
• Permanent account disabling

Account Disabling vs. Deletion

Tierloom does not permanently delete accounts by default. When an account is disabled for a policy violation, your data is preserved. You may email [email protected] to appeal the decision or request reactivation with supporting context within 14 days of the action.

To the fullest extent permitted by applicable law:

• Tierloom provides the platform "as is" and "as available." We do not warrant that the platform will be uninterrupted, error-free, or free of security vulnerabilities at all times.
• Tierloom is not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption.
• Tierloom is not liable for the actions, content, or conduct of any Creator, Brand, or Agency user on the platform.
• Tierloom does not guarantee campaign results, audience reach, engagement rates, or revenue outcomes.
• Creators and Brands are solely responsible for their own tax compliance obligations arising from income earned through the platform.
• Our total liability to you for any claim shall not exceed the total fees paid by you to Tierloom in the three months preceding the claim.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms — other than disputes covered by the Binding Arbitration clause in Section 7 — shall be subject to the exclusive jurisdiction of the competent courts located in India.

For international users: by using Tierloom, you consent to the jurisdiction of Indian courts and acknowledge that Indian law governs this agreement.

By creating an account on Tierloom, you agree to receive transactional communications related to your account, campaigns, payments, and platform updates via email and in-app notifications. These communications are necessary for the platform to function and cannot be fully opted out of while your account is active.

For marketing and promotional communications, you may opt out at any time by updating your notification preferences in account settings or by contacting us at [email protected].

Termination by You

You may close your account at any time by contacting [email protected]. Upon termination: any active campaign deals must be resolved first; premium subscription access ceases at the end of the current billing period; and no refunds are issued for unused subscription time.

Termination by Tierloom

We reserve the right to suspend or disable your account at any time, with or without notice, if you violate these Terms, engage in fraudulent activity, or if we determine that continued access poses a risk to the platform or other users.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tierloom regarding your use of the platform.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer your account or rights under these Terms without our consent. Tierloom may assign its rights and obligations without restriction.
• Force Majeure: Tierloom is not liable for any failure or delay in performance resulting from causes outside our reasonable control, including natural disasters, government actions, internet outages, or third-party service failures.
